This Privacy Policy has been drafted in compliance with European Regulation no. 2016/679 (the "Regulation"). The Regulation guarantees that the processing of personal data is carried out in compliance with fundamental rights and freedoms, as well as the dignity of the interested party, with particular reference to confidentiality and personal identity.


  1. Owner of personal data and responsible for the protection of personal data

1.1 Catria Confezioni SpA, with registered office in VIA 25 APRILE 7 CAP 61037 MAROTTA DI MONDOLFO (PU) - Italy, VAT number: 00162040414 (hereinafter "DEPARTMENT FIVE"), is the data controller of the personal data of users who browse the Site, including browsing data, marketing and profiling data, as well as data connected and correlated to sales made through the site and to the related pre- and post-sales activities.

  1. Type and purpose of the processing carried out on the site

Different types of personal data are collected and processed through the Site, for different purposes and in different ways. More precisely:

(a) personal data relating to navigation, processed both to allow the correct functioning of the Site and for marketing purposes. In this regard, we invite you to read the Cookie Policy present on the Site;

(b) personal data provided voluntarily by the user (email address, telephone number, personal data, password provided by completing the registration form), or otherwise provided during the iteration of the Site and/or through interaction with the customer care made available by DEPARTMENT FIVE and processed to respond to the user's requests and offer the services, assistance and information requested about the products and the world of DEPARTMENT FIVE. Please note that registration and access to the Site or to your customer account via social profile involve the communication of certain data (Name, Surname, E-mail and any other data relating to the user and present on the social network itself, which will in any case be listed to the user before his/her confirmation of wishing to proceed with authentication via social network). In any case, such communication will only take place following the explicit confirmation of the will to proceed expressed by the user before logging in. In some cases, social networks require obtaining some feedback and information about the use of the log-in. (c) personal data provided by the user in the context of the product purchasing processes on the Site for the conclusion of transactions and for activities functional and instrumental to the sale, as well as for any necessary pre- and post-sale assistance;

(d) personal, biographical and contact data, processed by DEPARTMENT FIVE – with express consent – ​​for marketing purposes, i.e. to send the user (via traditional tools and via electronic tools such as newsletters, e-mails, sms, mms and smart messages) information and updates on products, sales, promotional campaigns, events and other initiatives promoted by DEPARTMENT FIVE or its commercial partners;

(e) personal data relating to purchases and any preferences expressed, processed by DEPARTMENT FIVE – with express consent – ​​for the purposes of studying consumer habits and choices, in order to make products, initiatives and individual commercial proposals more responsive to the tastes and needs of its customers;

(f) personal data (e-mail address) provided at the time of purchase of products, to offer you products similar to those you have purchased, without prejudice to the possibility of communicating your desire not to receive such communications using the contact details referred to in paragraph 1 of this Privacy Policy or using the link present in each email communication you receive. In this case, DEPARTMENT FIVE will interrupt the activity without any delay.

 

Except for navigation data, regulated by the Cookie Policy, the processing of personal data is based on:

  1. DEPARTMENT FIVE's legitimate interest in providing the services of the Site and in responding to any customer requests, with reference to points (a) and (b) and in carrying out soft spam activities with reference to point (f);
  2. The fulfillment of the sales contract and the obligation to fulfill pre- and post-contractual obligations, for all the activities referred to in point (c);
  3. The consent possibly provided by the user for the purposes referred to in point (b) - with exclusive reference to Social login - and points (d) and (e).

 

  1. Source of personal data

The personal data collected by DEPARTMENT FIVE are provided directly by the user (through registration on the Site or as part of the sales process), with the exception of the navigation data referred to in the previous point 2 (a), for the data collected in the event of registration and access via social profile, as indicated in the previous point 2 (b) and for the sales data referred to in the previous point 2 (e).


  1. Study of users' habits and consumption choices

As indicated in the previous point 2 (e) and with the express consent of the user, DEPARTMENT FIVE may process the user's personal data for the purposes of studying consumer habits and choices in order to make DEPARTMENT FIVE products and initiatives more responsive to the tastes and needs of its customers.

With the help of automated tools, DEPARTMENT FIVE will process data relating to the value and frequency of purchases, as well as the type of products purchased. Data relating to consumption and preferences may be collected not only by tracking purchases made on the DEPARTMENT FIVE Site, but also through the user's interaction with DEPARTMENT FIVE and any information that the user may voluntarily provide such as consumer preferences (brands and products), hobbies, habits, lifestyle and favorite sports. This information may also be acquired through:

  • some social platforms. In any case, this will only happen if the user has previously agreed to communicate some of his/her data through the social platform when logging in for registration;
  • the use of cookies on the DEPARTMENT FIVE website, only where the user has expressly consented to the use of analytical and profiling cookies;

 

DEPARTMENT FIVE has the sole objective of offering customers and users products, services and initiatives that best meet their tastes and needs. In this regard, it is specified that the study of user and customer behavior will be carried out in a manner that is not invasive of the personal sphere. You can always request clarifications regarding the logic applied to this treatment and the modification of the results obtained by contacting DEPARTMENT FIVE at the contact details indicated.

As indicated in the previous point 2 (a) and with the express consent of the user, DEPARTMENT FIVE may also process the personal data of the user, using automated tools, to study cookies in order to verify navigation on the Site and propose products and services in line with the navigation activity.

  1. Methods of processing personal data carried out by Department5

The personal data collected through the DEPARTMENT FIVE website are processed using mainly computer and telematic methods and tools, adopting the necessary security measures in order to reduce to a minimum the risks of destruction or loss, even accidental, of the data themselves, of unauthorized access or of processing not permitted or not compliant with the collection purposes indicated in this Privacy Policy.

However, due to the nature of the online transmission medium, such measures cannot limit or exclude absolutely any risk of unauthorized access or data dispersion. To this end, it is advisable to periodically check that the computer is equipped with software devices suitable for protecting the transmission of data on the network, both incoming and outgoing (such as updated antivirus systems) and that the Internet service provider has adopted suitable measures for the security of data transmission on the network (such as firewalls and anti-spam filters).

  1. Mandatory or optional nature of providing data

With the exception of navigation data (the provision and collection of which are regulated by the “Cookie Policy”), the provision to DEPARTMENT FIVE of personal data collected through the Site both to respond to requests and questions from users, and for marketing purposes, to study consumer habits and preferences and for communication to third parties is free, optional and facultative. Failure to provide such data does not limit the use of the Site, but may make it impossible for DEPARTMENT FIVE to respond to requests for information and questions, or to send information material, updates, newsletters and invitations to DEPARTMENT FIVE events. The provision of personal data, in particular personal details, email address, postal address, telephone number and bank details (in the case of payments by credit card) is necessary with regard to the conclusion of the contract for the purchase of products through the Site. Some of the said data may also be essential for the provision of other services provided on the Site and related to sales (pre- and post-sales services, such as, for example, returns management) or to fulfill obligations arising from laws or regulations (tax obligations and anti-money laundering legislation). Failure to indicate the data may therefore constitute, depending on the case, a legitimate and justified reason for not executing the contract for the purchase of products on the Site and/or the provision of related services.

Where necessary, the mandatory or optional nature of the communication of data will be indicated from time to time, by placing a special character (*) next to the information necessary for the provision of services and for the purchase of products on the Site. Failure to indicate personal data indicated as optional or facultative will not entail any limitation or disadvantage for the user.

  1. Categories of recipients of personal data

DEPARTMENT FIVE communicates the personal data of the users of the Site only within the limits permitted by law and in accordance with what is indicated below. In addition to what is indicated in the previous point 2 b. (i.e. the Social login), the personal data may be known by:

  • employees and consultants of DEPARTMENT FIVE, who will operate as persons authorised to process data for the internal organisation of company activities;
  • companies of the same Group, which will operate as appointed data controllers, in order to carry out contractual activities and services as well as carry out specific marketing activities (such as inviting the user to events, sending discounts, promotions, etc.);
  • companies that perform specific technical and organizational services connected to the Site for DEPARTMENT FIVE, as data controllers (IT services, customer care services and marketing services).

 

Personal data may also be disclosed to:

  • third parties, solely to execute the contract for the purchase of products on the Site (such as the credit institution for the execution of remote electronic payment services by credit/debit card, couriers);
  • to the police or judicial authorities, in accordance with the law and upon formal request by such entities, or in the event that there are well-founded reasons to believe that the communication of such data is reasonably necessary to investigate, prevent or take initiatives relating to suspected illegal activities or assist state control and supervisory authorities; defend itself against any claim or accusation by third parties, or protect the security of its website and company; or exercise or protect the rights, property or safety of DEPARTMENT FIVE, companies of the same group, its affiliates, its customers, its employees or any other person.

 

  1. Data retention period

Personal data collected for sales purposes are retained for a period not exceeding 10 years from purchase, in compliance with tax and civil regulations and except for particular needs of defense in court that may require retention for a longer period. The data provided by the user to request assistance, information and feedback are retained for the time necessary to provide the requested feedback and any subsequent activity of any further iteration with the customer necessary to fully manage the request and/or problem.

The personal data provided for marketing, soft spam and profiling purposes are retained for the period necessary for the specific processing and up to a maximum of 7 years, also on the basis of the particular sector of activity (luxury products) and in consideration of the interest shown by the customer in receiving updates on products and events organized by DEPARTMENT FIVE.

  1. Rights recognized by privacy law to the user

The user always has the right to obtain from DEPARTMENT FIVE:

(i) confirmation of the existence or otherwise of personal data concerning him/her, even if not yet recorded, and their communication in an intelligible form;

(ii) information about the origin of your personal data, the purpose and method of processing, the logic applied in the event of processing carried out with the aid of electronic instruments, the identification details of the owner and the data controllers, the indication of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity, for example, as data controllers or as subjects authorised to process them;

(iii) the updating, rectification or, when interested, the integration of personal data;

(iv) the cancellation, transformation into anonymous form or blocking of personal data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed, as well as certification that the above operations have been brought to the attention of those to whom the data were communicated, except in the case in which such fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected;

(v) the portability of your data;

(vi) the limitation of the processing of data concerning him.

The user also has the right to object in whole or in part, for legitimate reasons, to the processing of his/her personal data, even if pertinent to the purpose of the collection and to revoke the consent previously given. The right to object and revoke consent may also be exercised specifically, with regard to one or more methods of sending marketing communications.
